Judgments and Settlements within a European judgments regime

28.1 A “European judgments regime” is one of that contained in EC Regulation 44/2001, the Brussels or Lugano Conventions.1 The relationship of the Regulation, the Brussels and Lugano Conventions is discussed in Chapter 4 and 8 The EC Regulation applies as between all EU Member States save Denmark2 and provides for the recognition and enforcement as between those States of the European Union of court judgments, authentic instruments and settlements. As between those States it supersedes the Brussels Convention but that Convention continues to apply as between those States and Denmark. The Lugano Convention applies as between the Member States of the European Union and Iceland, Norway and Switzerland (see Chapter 8).
