The Contract of Membership

A. IS THERE A CONTRACT OF MARINE INSURANCE?

5.1 It has not always been entirely certain whether or not the arrangements between a member and his P&I Club amount to an agreement which can fairly be regarded as a contract of marine insurance.1 Whether club cover amounts to a contract of marine insurance within section 1 of the Marine Insurance Act 1906 is a matter of some considerable importance. The Act applies only to “contracts of marine insurance” and would apply to P&I cover if mutual agreements fall outside the ambit of this phrase.2
