High Court limits scope of duty to warn in solicitor’s retainer

Cathal Anthony Lyons v Fox Williams LLP [2016] EWHC 2427 QB, 11 October 2016

The defendant solicitors were retained by Mr Lyons to advise on potential claims under his accidental death and dismemberment insurance policy (AD&D policy). Although the defendant was aware of the existence of a long-term disability policy (LTD policy), the engagement letter only referred to advice on the AD&D policy. Mr Lyons brought a claim against the defendant for failing to advise him on a potential claim under the LTD policy.
