Personal Injury Compensation
Preliminary issues of liability and causation
PXW (A Child) v Kingston NHS Hospital Trust [2019] EWHC 840 (QB)
The High Court has concluded, on the balance of probabilities, that advice provided to the claimant by a midwife was in accordance
with both the defendant’s guidance and the NICE guidance in respect of low-risk and uncomplicated pregnancies, so the claimant
failed to establish a breach of the duty of care in negligence. The claim also failed on causation.
