FXF v Ampleforth Abbey Trustees [2020] EWHC 791 (QB)

In a claim for historical sexual abuse by a priest, a judge in the High Court held that the limitation period for bringing a claim for damages should not be set aside. There had been a 32-year delay in bringing the claim, during which time the alleged perpetrator had died, and the cogency of the evidence had been greatly diminished, resulting in prejudice to the defendant trustees of the monastery and to the prospect of a fair trial.
