AG v AM (By His Litigation Friend, the Official Solicitor) [2020] EWCOP 59

The Court of Protection has considered whether it was in the best interests of a patient, who had been deprived of his liberty at a specialist nursing home under a 12-month standard authorisation, to be discharged to his family home. In a detailed and finely balanced hearing, the court concluded that despite considerable advantages to the patient were he to return home, the decisive point was that the reduced medical input available there would significantly increase his risk of suffering a deterioration in his health, and greater risk of hospital admissions and premature death.
