Ferrari secures CJEU victory in TM dispute

Italian supercar maker found to have genuinely used at-issue Testarossa mark through sales of spare-parts on a product it ceased to produce some 20 years ago

An EU trademark is still considered valid and in genuine use if the rightsholder is offering second-hand or spare part services, the Court of Justice of the European Union (CJEU) has ruled.
