Assens Havn v Navigators Management (UK) Ltd, Danish Supreme Court 5/2015, 9 October 2017

The CJEU decision in Assens Havn has featured twice recently in Shipping &Trade Law (see Hjalmarsson in the July/August issue ((2017) 17 STL 6 7) and Lavelle in the September issue ((2017) 17 STL 7 4)). There is now a further decision in the case - the order of the Danish Supreme Court, the court which referred the dispute to the CJEU.

The New Flamenco – UK Supreme Court clarifies the law on mitigation of damages

Introduction The decision of the UK Supreme Court in the case of The New Flamenco (Globalia Business Travel SAU v Fulton Shipping Inc of Panama [2017] 2 Lloyd’s Rep 177) was published on 28 June 2017 and has already been the subject of much comment. The decision clarifies the limits on the kinds of benefit which are to be brought into account by way of mitigation of damages for breach of contract.

Cyber attacks – legal implications on the shipping industry

"Cyber risk", as defined by the Institute of Risk Management, refers to any risk of financial loss, disruption or damage to the reputation of an organisation due to any sort of failure of its information technology systems. The cyber risk that digital technologies, devices and media can bring us are manifest and multi-dimensional, and in fact, it is never a matter purely encountered by the IT teams or certain sectors such as information technology service providers, defence contractors and financial service companies, although they clearly play a vital role.
