Serious irregularity: time limits
In RTI Ltd v OWH SE iL [2025] EWHC 1945 (Comm); [2025] 2 Lloyd's Rep 202 Butcher J considered whether an ad hoc application to the tribunal to admit that it had erred in its award operated to extend the 28-day period for lodging an appeal against the award. The argument was firmly rejected.

Construction of awards: the significance of the dispositive section
In Nigeria LNG Ltd v Taleveras Petroleum Trading DMCC [2025] EWCA Civ 457; [2025] 1 Lloyd's Rep 549 the Court of Appeal upheld the ruling of HHJ Pelling KC that the dispositive section of an award was presumed to be exhaustive of the obligations placed on the parties to the award and was not to be read as supplemented by other parts of the award.

Jurisdiction: preliminary ruling by the court
In Barclays Bank plc v VEB.RF [2024] EWHC 2981 (Comm); [2025] 1 Lloyd's Rep 59 HHJ Pelling KC considered an application under section 32 of the Arbitration Act 1996 made by one party with the permission of the tribunal rather than with the consent of the other party, for a preliminary ruling on jurisdiction. The decision, in favour of the application, is a useful discussion of the application of the statutory criteria.

Anti-suit injunctions: extension to third parties
In Asiana Airlines Inc v Gate Gourmet Korea Co Ltd and Others [2024] SGCA(I) 8; [2025] Lloyd's Rep Plus 13 the Singapore Court of Appeal, hearing an appeal from the Singapore International Court, considered at length the circumstances in which an anti-suit injunction may be granted to restrain overseas proceedings against persons who are not party to the arbitration clause.
