Enforcement by arrest and court sale

14.1 Introduction

14.1.1 This chapter concerns the enforcement of the ship mortgagee’s security by way of the arrest and judicial sale in England and Wales1 of the mortgaged ship, usually through a court-directed tender process. Enforcement of mortgage security by the exercise of self-help remedies has been discussed in Chapter 11. The courts’ protection of the mortgagor in relation to the exercise of the mortgagee’s self-help remedies has been discussed in Chapter 12.
