Admiralty practice - Whether expenses incurred by shipyard owners during period of vessel’s arrest to be classed as Sheriff’s expenses notwithstanding that the prior consent of the Sheriff had not been obtained

The vessels Nagasaki Spirit and Ocean Blessing were involved in a collision in the Straits of Malacca. All but two of the crew of the Nagasaki Spirit and all the crew of the Ocean Blessing died. After the collision, the hulk of the Nagasaki Spirit was berthed alongside at the shipyard of Hitachi Zosen Singapore Ltd (“Hitachi”) with the acquiescence of Hitachi.
