Whether application to amend defence should be granted

This was an application to amend a defence. A dispute had arisen out of cargo shipped aboard Kyoan Maru . The cargo did not arrive and the cargo insurers instructed solicitors to investigate, as a result of which a writ was issued on behalf of the cargo owners against four defendants. The third defendants were the registered owners of the vessel.
