The Arcadian Valor

“In rem” seizure unconstitutional

A creditor directed the marshal of the Eastern District of Lousiana to seize m/v Arcadian Valor in order to enforce a maritime lien resulting from an alleged failure to pay for services rendered. The seizure was authorised by rule C of “Supplemental Rules for Certain Admiralty and Maritime Claims, Federal Rules of Civil Procedure”, which permits the seizure of a vessel without prior notice to the owner.
