Liability for total loss of cargo

A claim for the total loss of cargo on board the Golden Leader which stranded and sank came before the Court on a special case stated by an arbitrator. The question for decision was whether the owners were liable for the loss of the cargo, assuming the loss to have been caused by the stranding of the vessel (whether due to negligence or not) and not by any of the clauses mentioned in cl.2 of the Gencon charter which provided:
