Canadian Pilotage Regulations ultra vires (see LMLN 30)

Pilotage Regulations promulgated under the Canadian Pilotage Act 1971 established five compulsory pilotage areas. Section 9(1) of the Regulations stipulated that ships over a certain tonnage would be subject to compulsory pilotage in those areas. Section 9(2)(a) exempted from compulsory pilotage any ship registered in Canada and satisfying certain conditions as to status, employment and crew qualification. Section 10(1)(a) allowed a ship registered in the United States to obtain a waiver from compulsory pilotage under certain conditions.
