Claim for arrears of wages - Whether action should be stayed
The plaintiff seamen brought an action in Cyprus against the owners of the
Christos
for arrears of wages. The owners, a limited company registered in Cyprus, applied for the proceedings to be stayed on the
ground that the contract of employment contained an exclusive jurisdiction clause providing that such contract should be governed
exclusively by Greek law, “. . . resort to any foreign Courts and to any foreign law being prohibited and expressly ruled
out.” The owners’ application was based on certain rules of the Cyprus Admiralty Jurisdiction Order 1893 and on the practice
and the inherent powers of the Admiralty Court.
