No relief for charterers where vessel withdrawn for late hire payment

The House of Lords has now definitively stated that the High Court has no jurisdiction to grant relief against the exercise by a shipowner of his contractual right, under the withdrawal clause in a time charter, to withdraw the vessel from the charterer’s service where the charterer has failed to pay hire punctually in accordance with the charterparty.
