Kuwaiti marine insurance policy - Whether governed by English law - Whether leave should be given to serve writ out of jurisdiction

The plaintiffs were a Liberian incorporated shipping company carrying on business in Dubai, and were the owners of the vessel Al Wahab. The plaintiffs sought to litigate in the English commercial court their claim against the defendant insurers for a constructive total loss of the vessel which occurred in Saudi Arabia. The vessel had been insured by the defendants under a hull and machinery policy which had been issued in Kuwait. The defendants had their head office in Kuwait, but had no office or representative in England.
