Title 46 of the United States Code, which contains inter alia the Harter Act and Carriage of Goods by Sea Act (“COGSA”), was recodified in 2006. The Harter Act, previously found at 46 U.S.C. § 190 et seq., was recodified to 46 U.S.C. § 30701 et seq. COGSA no longer has its own statutory code reference and is now found in the “note” to 46 U.S.C. § 30701. According to the notes to § 30701, in this recodification “[c]hanges are made to simplify, clarify, and modernize the language and style, but the intent is that these changes should not result in changes in substance.”
