THE PURPOSES OF ARBITRATION

1.1 The use of private means to settle disputes between parties has long been established in England, and the merits of arbitration have been accepted by the English courts for over four centuries.1 Parliament first formally approved the arbitration process in 1698, the preamble to the 1698 Act2 stating:
