NS Tractors & Equipment Ltd. v. The owners of the Tarros Gage) - Fed.Ct. (Trial Div.) (Teitelbaum J.) - 24 February 1986

Package limitation - ”Customary Freight Unit”

The plaintiff cargo interests claimed damages for the loss of a Crawler Backhoe which was being shipped on the vessel Tarros Gage . The Crawler Backhoe weighed 84,400 lbs and was valued at $162,916. The bill of lading incorporated the Hague Rules, Article IV, rule 5, of which made provision for limitation of the carrier’s liability.
