The plaintiff had been injured when working as a deckhand on a tug in a Swedish fjord and claimed damages for personal injuries.
The judge found that the accident was caused by the negligence of the master of the tug. However, the plaintiff was not directly
employed by the tug owners and the main question was whether the plaintiff’s direct employers were liable for the tug master’s
negligence.
