Hague Rules - Whether time-charterer is “carrier” under contract of carriage

The plaintiff cargo owners claimed damages for loss of their cargo against the owners and the time charterers of the vessel Newfoundland Coast . The main issue was whether the charterers (CN Marine) were liable as carriers. CN provided a passenger and freight service to the coasts of Newfoundland and Labrador. The service was provided by means of vessels which were either owned by CN or chartered by it.
