Marine insurance - Whether fishing vessel scuttled off Kangaroo Island

The vessel Gemini was a 58 foot, 58 grt. steel fishing vessel intended for professional tuna and shark fishing in local waters. The plaintiffs purchased the vessel for $210,000 in 1981. Thereafter, she was a financial disaster for them until she sank. After her loss the plaintiffs claimed $360,000 from underwriters. She had been insured under a time policy in force for 12 months from 13 July 1982.
