On 16 November 1983 the vessel Attika Hope was time chartered on the NYPE form. On 15 December 1983 the disponent owners voyage-chartered her to the defendants. The disponent owners were at that time in difficulties in discharging debts to the plaintiffs. Telex exchanges took place which the plaintiffs alleged amounted to an assignment by the disponent owners to the plaintiffs of freight under the voyage charterparty which was eventually concluded on 15 December.
