The defendant vessel was arrested pursuant to a warrant of arrest issued on 2 June 1987. At the time of the arrest the vessel was berthed at the wharves of Fraser Surrey Docks Ltd. (“Fraser Surrey”), the sole remaining claimant, other than the plaintiff, to the proceeds from the judicial sale of the vessel.
