Malicious Prosecution

Gregory v Portsmouth City Council (H of L TLR 2 February; NLJ 4 February p131)

A subcommittee appointed by the local council to investigate allegations against one of its councillors had been held by the Divisional Court to have acted beyond its powers when it made findings and recommended that the councillor be removed from the committees of which he was a member. Following the finding of the Divisional Court, the councillor instituted proceedings claiming damages for malicious prosecution.
