New Human Rights and Pension Rules

The Family Proceedings (Amendment) Rules 2000 amend the Family Proceedings Rules 1991 in two main respects. Rule 10 inserts a new rule 10.26, providing a procedural code for cases concerning the Human Rights Act 1998 including the requirement that any party who seeks to rely on any provision of or right arising under the Act or seeks a remedy available under the Act shall state that fact in his originating document or answer, giving precise details of the Convention right which it is alleged has been infringed and details of the alleged infringement; specify the relief sought; state if the relief sought includes a declaration of incompatibility.
