Application for Wasted Costs Against LSC

Stein v Blake (No 3) (TLR 31 October Ch D)

An order that the Legal Services Commission should attend court to show why it should not be ordered to pay the costs of an unassisted party arising out of an adjournment did not have the effect of reversing the burden of proof. It would be contrary to human rights principles that an order made in the absence of a party who had not been given notice of the application should interfere with that party’s rights more than is strictly necessary.
