Atkinson v McKintosh (CLW 20 October CA)

The defendant had managed the claimant’s small retail business for a short period of time, as a result of which the claimant alleged the defendant owed her a substantial amount of money. The trial judge granted the claimant, who was acting in person, an adjournment to give her a further opportunity to prepare her accounts. The defendant appealed, contending that the judge had erred in the exercise of his discretion and that the claimant should have been in a position to prove her loss at the close of the evidence.
