Lewis v Inland Revenue Commissioners and others (TLR 15 November CA)

The liquidator of a company in voluntary liquidation sought an order that he be at liberty to use the realised funds of the company for the commencement of proposed proceedings against the former directors for wrongful trading and wrongful preferences. His application was opposed by the preferential creditors.
