Miller v Allied Sainif (UK) Ltd (TLR 31 October Ch D)

CPR rule 42.3 provides that a solicitor may apply for an order declaring that he has ceased to be the solicitor acting for a party in an application supported by evidence notice of which must be given to the client. In a simple case it is appropriate to allow the solicitor to make the application in writing where to require the attendance of a solicitor would simply take up court time and lead to an increase in costs. Nevertheless, in a complex case, solicitors who wish to come off the record would be well advised to attend.
