Costs – What Crisis?

With the President of the Law Society calling on the government to think again about the practice and procedure for recovering after-the-event insurance premiums where no proceedings have been commenced, resulting in high volumes of satellite litigation clogging up the courts which could ‘scupper the whole process’, and a legal expenses underwriter decrying those who do not take out policies unless and until litigation is unavoidable as ‘driving a coach and horses through the Access to Justice Act’, Senior Costs Judge Peter Hurst has given guidance to the Designated Civil Judges as follows:
