Review of Arbitrators’ Fees and Expenses

Hussman (Europe) v Al Ameen Developments ([2000] 2 Lloyds Rep 83, QBD)

The claimants applied for an order under s28 of the Arbitration Act 1996 that the court should consider the arbitrators’ fees and expenses and adjust them on the grounds that they were excessive. The arbitrators resisted the application on the grounds that their fees and expenses were fixed by the Euro-Arab arbitration system and that the court had no jurisdiction to interfere.
