Disqualification of Directors

In Re Pantmaenog Timber Company Ltd (TLR 23 November Ch D)

Once proceedings have been commenced to disqualify directors of a company, the Official Receiver may not use his statutory powers governing inquiries into the company’s dealings by administrators and liquidators to obtain information about the directors’ conduct. Accordingly the district judge should not have made orders directing the production of documents by a firm of accountants and two firms of solicitors to obtain information in support of his application for a disqualification order.
