Bullying at Work

Waters v Metropolitan Police Commissioner ([2000] All ER (D) 1070 H of L)

The House of Lords, not following previous decisions of the Court of Appeal, found that the relationship between a constable and the Metropolitan Police Commissioner produced duties analogous to those owed to an employee by an employer. A person employed under an ordinary contract of employment could have a valid cause of action in negligence against an employer if the employer failed to protect the employee against bullying, victimisation and harassment which caused physical or mental injury.
