Save And Prosper Pensions Ltd v Homebase Ltd (Unreported 2 March 2000 Ch D)

C was appointed arbitrator in a review of rent on premises leased by SP to H. SP applied to removed C as arbitrator because he was a partner in a firm which had been instructed in a different matter by another company, D, which had the same parent company as H. The court upheld SP’s contention that there was danger of bias towards H because it was sufficiently linked to D to give a real possibility of bias to C’s dealings with H.
