Litigation Letter
Reconsideration by Judge
Kirin Amgen INC And Others v Transkaryotic Therapies In and Others Ch D TLR 1 June 2001
CPR rule 52.4 changed the date from which the time for appeal starts to run to the date when judgment was given. Did this
affect the jurisdiction of a judge to review and change his mind on a conclusion reached in his judgment at any time before
the order was drawn up? Under the old procedure the power of the first instance court to review at any time until the order
was drawn up was consistent with the case not being subject to an appeals regime until that point. It was argued that now
the appeal regime started to apply from the moment judgment was given the power to review no longer existed.
