FDR outcome was binding

Rose v Rose (CA TLR 14 March)

On a financial dispute resolution hearing, the High Court judge, after hearing submissions, gave a broad indication of his view as to what the outcome would be should the case go for a contested hearing. The parties negotiated on the basis of the judge’s indication and eventually the husband accepted the wife’s proposed terms for a clean break. The terms were put before the judge who stated that he was happy to record the agreement. Detailed drafting was not attempted.
