Pre-emptive costs order

Chessels v BT (Ch D 20 December)

It is not appropriate to order that the costs of an appeal by a minority group of members in a pension scheme, who had been disadvantaged after the court had provided guidance in relation to that scheme, should be paid from the funds of the scheme, the minority group’s position being analogous to beneficiaries making a hostile claim against trustees or other beneficiaries.
