Hamilton v Al Fayed and others (CA The Telegraph 23 May)

Al Fayed’s appeal against the refusal of the court to allow him to recover unpaid legal costs from individuals who had funded the claimant in his unsuccessful libel action was dismissed. The court held that in the absence of exceptional circumstances those funding the claimant were under no obligation to pay the defendant’s costs.
