False endorsement

Irvine and another v Talksport Ltd (Ch D [2002] 2 All ER 414)

The defendants purchased from a photograph agency, a photograph of the British Formula 1 racing driver, Eddie Irvine, which they placed on the front of their brochure, having imposed on it the image of a portable radio to which the name of the defendants’ radio station had been added. The claimant claimed damages for passing off by way of false endorsement.
