Removing the liquidator
AMP Enterprises Ltd v Hoffman (Ch D TLR 13 August)
It should not be regarded as easy to remove a liquidator, because that would encourage applications by disgruntled creditors.
Where a liquidator fails to be efficient, vigorous and unbiased in his conduct of the liquidation, the court will remove him.
The burden is upon the persons seeking the order to remove and replace a liquidator to establish good grounds for so doing.
