Litigation Letter

Hear-by dates reduced

In Practice Note (Court of Appeal) (Civil Division): Listing Windows and Hear-By Dates, handed down on 10 March by the Master of the Rolls, he said that in July 2001 a reduction in the Court’s hear-by dates had been announced. The Court’s longest hear-by date was reduced to 10 months. That had previously been 15 months before its subsequent reduction to 12 months. In respect of appeals or applications filed after 1 March 2003, the longest hear-by date would be nine months. Many hear-by dates would of course be considerably shorter. The start dates of many listing windows would also be brought forward by one month, from that date. That represented a further significant improvement in the service provided by the Court. The arrangements for dealing with applications for expedition and for a hearing to be fixed beyond a hear-by date remained as prescribed in the practice note of 4 July 2001.
