The Court of Appeal in Hollins v Russell and other appeals (22/ LL p73) and the Civil Justice Council’s Costs Forum (22/ LL p1) attributed much of the satellite litigation arising out of conditional fee agreements to the operation of the indemnity principle coupled with the complexity of the CFA Regulations. The Government’s response has been swift.
