Instructing second expert
Beck v Ministry of Defence CA TLR 21 July
In a personal injuries claim where a claimant has been examined by an expert for the defendant who is dissatisfied with his
report and wishes to instruct a second expert, the defendant is required to disclose the first expert’s report as a condition
of instructing a new expert. No room should be left for a claimant to wonder whether the application for a second report is
really due to the first report of a defendant’s medical expert being favourable to the claimant.
