Committal of recalcitrant mother

In re K (contact: committal order) [2003] 2 FCR 336

The mother consistently refused contact between the children and their father. When she refused to comply with an order for contact at a contact centre the father applied for her committal. She was given a suspended sentence of committal. She still refused to comply, so the father applied for the suspension to be lifted. The mother’s public funding had been withdrawn because of her unreasonable behaviour, and after several adjournments to enable the mother to obtain legal representation, the mother, still unrepresented was sent to prison.
