Litigation Letter
CFA opportunity missed
Writing in the
New Law Journal of 31 October, Professor John Peysner regretted that CFA lites will not have an opportunity to be thoroughly tested. They
do not allow solicitors to recover the disbursements against their clients in any event; there may be difficulties in tying
in after-the-event cover to this type of CFA and, as yet, there is no Law Society-approved client agreement to support CFA
lites that might give some confidence to the profession. He suggested that the Rules Committee might produce a model client
agreement to bolster the new provision.
