Enhanced interest

R v Bryn Alyn Community (Holdings) Ltd [2003] EWCA Civ 383

Although the claimant succeeded in exceeding his Part 36 offer, the trial judge refused to award enhanced interest under CPR rule 36.21(3). The Court of Appeal could not discern any reason why enhanced interest might have been refused unless the claimants had been publicly funded, which was not a basis for refusing interest. The Court awarded interest on costs at 4% over the base rate from the date on which the work was done, or liability for disbursements was incurred, until the date of the order for costs.
