Calculating one year of service

The employee was dismissed without the statutory seven days’ notice, but even after adding in the seven days, she had still
failed to complete the requisite one-year service for claiming unfair dismissal. However, if she were found to have been entitled
to her contractual notice period of three months she would have satisfied the one-year condition, in which event the employment
tribunal found that she would have succeeded in her unfair dismissal claim.
